"For all the Ways You Care" Contest Official Rules

THIS PROMOTION IS OFFERED ONLY TO LEGAL RESIDENTS OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA. VOID WHERE PROHIBITED BY LAW.

  1. Eligibility: To enter the “For all the Ways You Care” Contest (the “Contest”), you must be a legal resident of one of the fifty United States or the District of Columbia who is age 18 or older as of the date of entry. Employees of CVS/pharmacy (“Sponsor”), its parent companies, subsidiaries, affiliates, franchisees and advertising or promotional agents, and members of the immediate families (parent, child, or sibling) or households of any such employees, are not eligible to enter.

  1. Contest Period: The Contest begins at 12:01 a.m. E.T. on October 5, 2008 and ends at 11:59 p.m. E.T. on March 1, 2009 (the “Contest Period”).

  1. How to Enter: To enter, visit www.forallthewaysyoucare.com (the “Website”) during the Contest Period and follow the entry instructions. Entrants will be required to complete and submit via the Website an Official Entry Form (including without limitation their name, and e-mail address) and an essay about care-giving of no more than 2,000 words written by the entrant. The essay must describe one living person (the “Essay Subject”) (who may be either the entrant or someone known to the entrant) who (a) is at least 18 years of age, (b) is a legal resident of one of the fifty United States or the District of Columbia, and (c) cares for other people). Entries must be received by 11:59 p.m. E.T. on March 1, 2009 to be eligible. There is no limit on the number of entries per person, but each entry must be original and unique. Submission of duplicate essays will constitute grounds for disqualification. All entries and components thereof become the property of Sponsor and will not be returned. Entrants will be required to provide current contact information for the Essay Subject in order that Sponsor may contact potential Honorees (as defined below). Essays must be original, must have been written solely by the entrant, must be an account of actual caregiving-related events involving the entrant or of which the entrant has firsthand knowledge, and must comply with basic grammatical rules such that in Sponsor’s determination they are suitable for public display. Essays must not contain any of the following: (a) any material that would violate or infringe upon the rights of any third party, including without limitation copyrights, trademarks or rights of privacy or publicity; (b) any identifiable brand names; (c) any material that Sponsor in its discretion determines is mean-spirited, spiteful, controversial or otherwise inappropriate for display on the Website.

  1. Selection of Winners and Awarding of Prizes: Prizes will be awarded to the Essay Subjects described in the winning essays (the “Honorees”). Honorees shall not be the entrants who submitted the winning essays except in cases where the entrant is the Essay Subject. Prize recipients will be determined as follows: Sponsor may conduct a preliminary review of each essay’s compliance with the provisions of Paragraph 3 above, and any essays that Sponsor in its discretion determines do not comply fully with such provisions will be disqualified. Such preliminary review shall not limit Sponsor’s ability to disqualify any entrant and/or essay at any time for noncompliance with these Official Rules. The remaining essays will be reviewed by an editorial panel designated by sponsor (the “Editorial Panel”), who will rate each entrant’s essay on the basis of the following criteria (the “Judging Criteria”), weighted equally: the story clearly demonstrates how the Essay Subject cared for someone in a meaningful way and made/makes a difference in that someone’s life; the story expresses the emotional, as well as the physical, aspects of caregiving; the story has the ability to inspire others. The thirty (30) essays rated the highest by the Editorial Panel, based on the foregoing criteria, will be the “Finalists.” In the event of a tie, the essay with the higher “the story has the ability to inspire others” score will be selected as the Finalist essay. After the Finalists have been determined, they will be reviewed by an advisory panel of leading women and men in America (the “Judges”) designated by Sponsor, who will rate each Finalist essay on the basis of the Judging Criteria. The highest scoring Finalist essay, based on the foregoing criteria, will be the Grand Prize essay, subject to verification. The next nine highest-scoring Finalist essays, based on the foregoing criteria, will be selected as the Runner Up essays, subject to verification. In the event of a tie, the Finalist essay with the higher “the story has the ability to inspire others” score will be selected. The entrants who submitted the Grand Prize and Runner Up essays will be notified by email, telephone or mail, in Sponsor’s discretion. If any such entrant is unreachable during a period of forty-eight (48) consecutive hours, such entrant may be disqualified and in such event a prize will not be awarded to the Essay Subject described in the entrant’s essay. Any such entrant who is notified will be required to provide current contact information for the Essay Subject in order that Sponsor may contact potential Honorees. The potential Honorees will also be notified by email, telephone or mail, in Sponsor’s discretion. If any potential Honoree is unreachable during a period of forty-eight (48) consecutive hours the potential Honoree may be disqualified. Each potential Honoree and each entrant who submitted a winning essay will be required to execute and return to Sponsor within one (1) week of receipt an affidavit of eligibility (certifying, among other things, that the essay is original, was written solely by the entrant, is an account of actual events involving the entrant, and does not contain any material that would violate or infringe upon the rights of any third party, including without limitation copyrights, trademarks or rights of privacy or publicity), a liability and publicity release, and an assignment of rights in and to all entry materials (including the essay), as applicable, or the potential Honoree may be disqualified. Honorees will be required to submit a recent photograph of themselves. Sponsor may, in its discretion, at an earlier stage in the judging process also require affidavits of eligibility, liability and publicity releases and assignments of rights to be completed and returned by entrants who have not yet been selected as potential winners. The guest who will accompany the Honoree on the trip that is a component of the prize will also be required to execute and return a liability and publicity release within one (1) week of delivery to Honoree. Verification of Honoree’s eligibility to receive prize may include, without limitation, a background investigation, and entrants agree to supply any authorizations or permissions deemed necessary by Sponsor in connection with any such investigation. In addition to being reviewed by the Judges as described above, some or all of the submitted essays may also be posted for public viewing at the Website, and visitors to the Website may be invited to rate each essay and/or vote for their favorites. However, such public viewing, rating and/or voting will not be used as a basis for winner selection.

  1. Prizes: One (1) Grand Prize: The grand prize consists of the sum of $25,000 (form of payment to be determined by Sponsor); round trip air transportation for the Honoree and one (1) guest between the major airport nearest to Honoree’s home and the destination airport, which will be determined by Sponsor in its discretion; standard double occupancy hotel accommodations for Honoree and guest for two (2) nights at a hotel selected by Sponsor (room rate and taxes only; size and type of room determined by Sponsor); two (2) theater tickets to a Broadway Show, subject to availability; dinner for two (2) (winner and guest) at a restaurant selected by Sponsor in its sole discretion; car service to and from airport and destinations throughout the three (3) day trip; and attendance for the Honoree and guest at a luncheon at a location to be determined by the Sponsor. Nine (9) Runner Up Prizes: Each of the nine (9) runner up prizes consists of the sum of $10,000 (form of payment to be determined by Sponsor); round trip air transportation for the Honoree and one (1) guest between the major airport nearest to Honoree’s home and the destination airport, which will be determined by Sponsor in its discretion; standard double occupancy hotel accommodations for Honoree and guest for two (2) nights at a hotel selected by Sponsor (room rate and taxes only; size and type of room determined by Sponsor); two (2) theater tickets to a Broadway Show, subject to availability; dinner for two (2) (winner and guest) at a restaurant selected by Sponsor in its sole discretion; car service to and from airport and destinations throughout the three (3) day trip; and attendance for the Honoree and guest at a luncheon at a location to be determined by the Sponsor. General Prize Terms and Conditions: Sponsor may provide first class air transportation if it is available for the Honoree’s itinerary and if Sponsor determines in its discretion that provision of first class air transportation is practicable. Sponsor reserves the right in its discretion to provide coach class air transportation. In addition, Sponsor reserves the right to substitute ground transportation in the event winner’s residence is 200 miles or less from destination. Trip itinerary and related details will be determined solely by Sponsor. If Honoree is not available to travel on dates specified by Sponsor, the prize may be forfeited and awarded to an alternate winner. Guests must be 18 years of age or older, unless the Honoree is the guest’s parent or legal guardian. Approximate retail value (“ARV”) of the grand prize is $31,700. Approximate retail value (“ARV”) of each of the runner up prizes is $16,700. Exact value will depend on market conditions at time of prize fulfillment and where the winner resides. Any taxes payable on the value of any prize are the sole responsibility of the prize recipient. An IRS form 1099 will be issued if required by law. No substitution or transfer of rights to prizes will be allowed, except at sole discretion of Sponsor. Sponsor reserves the right to substitute alternate prizes of equal or greater value. Limit one prize per person. If more than one essay submitted by an entrant is identified by the Judges as among the ten highest-scoring essays, only the entrant’s highest-scoring essay will be considered. LIMIT: One (1) prize per person.
  1. General Rules: Sponsor may at any time disqualify any entry that it deems to have violated any provision of the Official Rules. Sponsor’s decisions are final. Entry constitutes a grant of permission to Sponsor and its parent companies, affiliates, subsidiaries, promotional partners and agents, and those they may designate from time to time, to use the name, likeness, and city and state of residence of the entrant and the Essay Subject, and all entry materials (including the essay), including without limitation modifying, altering or amending the essay, for purposes of trade, publicity or promotion, in all media whether now known or later developed, without any additional notice or compensation (except where prohibited by law). Without limitation of the foregoing, each entrant and Essay Subject agrees, at Sponsor’s request, to participate in a photo shoot, television shoot and/or other activities in connection with the production by Sponsor of advertising or marketing materials relating to Sponsor and/or the Contest. Entrants and Essay Subjects will be required to execute all releases, consents and other agreements that Sponsor in its discretion may require in connection with the exercise by Sponsor of the rights granted to it herein. By entering the Contest, each entrant agrees that the Sponsor may display the entrant’s essay online at Sponsor’s website for public viewing and comment. Submission of any entry constitutes entrant’s consent to irrevocably assign to Sponsor any and all right to entry materials, including without limitation all intellectual property rights therein. Essays must not contain any elements whose use by Sponsor in accordance with the terms hereof would require the permission of or payment to any third party. If required by Sponsor, entrants must secure from any third parties identified in any essay consent to the use of such essay by Sponsor as permitted herein. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and/or to cancel, modify or suspend this Contest should entrant fraud or misconduct or other causes beyond the control of the Sponsor corrupt the administration, integrity, security or proper operation of the Contest. In the event of termination of the Contest, a notice will be posted online. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest, or in the announcement of the prize. All entrants release Sponsor and its parent companies, affiliates, subsidiaries, promotional partners and agents, and all others associated with the development and execution of this Contest, from any and all claims and liabilities arising from or in connection with participation in this Contest, including without limitation claims for injury, loss or damage of any kind resulting from participation in this Contest or acceptance or use of any prize. Void where prohibited or restricted by law. All federal, state, and local laws and regulations apply. Sponsor is not responsible for lost, late, illegible, incomplete, damaged, mutilated, misdirected, misdelivered, or delayed entries, or for technical or human errors or failures of any kind in connection with the submission, transmission, processing or judging of entries, including without limitation any malfunctions or failures of computer hardware, computer software, networks or telephone equipment or any technical problems or traffic congestion on the Internet or at any website or any combination thereof. Sponsor’s clock will be the official time clock for the Contest. Caution: Any attempt by an entrant to deliberately damage any Web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent of the law.
